Terms & Conditions

The following terms and conditions form the basis of a contract between Nick Watson / NJW Images and the person(s) reserving and booking a workshop.

1. Booking, Deposits and Payments

1.1 If a deposit is required to secure a place on the workshop, this will be noted in the workshop description and will be required at the time of booking. The remaining balance is payable 6 weeks prior to the workshop date. If final payment is not made with 6 weeks of the workshop date I reserve the right to treat the booking as being cancelled. All deposits are non-refundable. If a booking is made within 6 weeks of the workshop date then the full amount shall be payable at the time of booking.

1.2 If there is no deposit required then full payment is required at the time of booking.

1.3 The workshop cost covers the tuition fee only unless stated otherwise in the workshop description.  All other expenses are the responsibility of the client. The workshop cost does not include any transportation to and from the workshop location, or any insurance cover for trip cancellation/interruption, travel accident, travel delay, loss, theft or medical expenses.

1.4 Gift vouchers are non refundable, however they are valid for 6 months from the date of purchase.

2. Cancellations & Amendments

2.1 I reserve the right to make amendments to the details and itinerary of any workshops at any point.

However, in the event of such an amendment substantially changing the itinerary of a workshop you will be notified and offered a choice of:

  • a) accepting the amendment;
  • b) booking a place on an alternative workshop (any overpayment will be refunded);
  • c) accepting a full refund of any money paid and withdrawing from the contract.

2.2 I also reserve the right to amend the advertised cost of any package if that cost has been advertised incorrectly. You may in this case cancel the booking and all monies paid will be refunded in full.

2.3 Any cancellation made by yourself must be done in writing or via email.

2.4 If a cancellation is made with 61 days or more remaining until the workshop date then you will be refunded any monies paid, less a deposit if it was required at time of booking. If a cancellation is made with 60 days or less remaining but more than 31 days then any monies paid will be refunded less deposit & 50% administration costs. Any cancellation made with 30 days or less to date of departure will not be eligible for a refund.

2.5 Although I have rarely had to cancel any workshops, I reserve the right to cancel any workshop for any reason. You will be notified and offered a choice of either:

  • a) A place on an alternative workshop (any overpayment will be refunded);
  • b) A full refund and withdrawing from the contract. Any refunds of money held for longer than 60 days will be made by bank transfer within 30 days of cancellation.

3. Physical Condition

3.1 You must generally be in good health and it is vital that if you have ANY medical problems, make them known well before the workshop begins. Although we carry general first aid items, it is understood that you are responsible for your own general health. I reserve the right to cancel your booking if a health concern could compromise your ability to participate. These workshops may be taken by anyone in good physical condition.  There are times when you may have to walk over irregular terrain as well as carrying your equipment.  Please call me if you have any questions or concerns about your ability to do a particular trip.  Once a trip has started, if it is necessary for you to leave the trip because it is beyond your physical level, please note that there will be no refunds for any unused portion of the trip.

4. Personal Injury and Loss

4.1 I will not accept responsibility or liability for death, physical injury, illness or any other harm caused to the client unless it arises from direct negligence caused by myself.

4.2 I do not accept responsibility for the loss of or damage to any items, personal effects, clothing, money, equipment, photographic or otherwise.

5. General

5.1 If you have any special requests or requirements you should inform me of these prior to the workshop. I will endeavour to meet any reasonable requirements, however I cannot guarantee that such requests will be met. Unless I have confirmed in writing that such requests have been agreed, I have no requirement to meet the request.

5.2 You should understand that a reasonable amount of flexibility will be required with the workshop. Variables such as weather and tides can affect our itinerary, I will make adjustments where necessary to ensure that we get the most out of the trip.

5.3 (Skye/Wales/Glencoe trips only) If you have any special dietary or other requests you should inform me of these prior to arriving. I will endeavour to cater to your requirements, but cannot guarantee that such requests will be met and will have no liability to you if such requests are not met.

5.4 No refunds will be given in the event of bad weather, this is out of my control and I cannot be held responsible. If the forecast looks dreadful and it’s a viable option to rearrange then that will be the option given.

5.5 If a complaint arises after the workshop that could not have reasonably be dealt with at the time, you should inform me in writing within 14 days of the perceived incident.

5.6 Payment for your booking, either in full or as a deposit acts as your acceptance of these terms and conditions.
